Was it really a misdeal?

Question:

We have a guy in our weekly game that has a habit of pre-dealing the flop, turn, and river (all face down).I guess to save time, I dono, but here is what happened.

The player that does this "pre-dealing" of the cards was the dealer and involved in a all-in showdown. after he was called, both players revealed their hands.

By accident, he thru in the 3 "flop" cards in the muck pile and dealt the flop out of the remaining deck. He was beat, and was "knocked out". One of the other players realized what had happened and mentioned it and the "dealer" declared a misdeal and pushed to "split the pot". It really upset the player with the winning hand. I argued that the hand should stand.

Two hands later...same players...all-in...and the "dealer wins with a pair of kings against a pair of queens. The losing player got really upset because he felt that the other guy should have been put out of the game earlier. He left the game in disgust and left over $9000 in chips on the table.

I still believe that the mis-delt flop should have stand. what to you think?

Answer:

Hi Barry,

I think that the hand should stand. I don't know if there is any official rule pertaining to this particular situation, but letting the misdealt flop stand seems to be the most logical and fair thing to do. The mistake didn't influence how the hand was played at all, and you should only declare a misdeal when it's absolutely necessary. Of course, no one can no what would have happened if the original flop cards had been dealt, but that's beside the point.

You don't mention what cards the players were holding, but if the dealer was an underdog he could have made the "mistake" purposely, just to get out of a tricky situation. Not declaring a misdeal when the dealer makes a mistake is a good way to avoid suspicions of foul play.
