Re-shuffle or not re-shuffle?

Question:

I was playing in a tournament last night last night when we had a situation happen that I have never seen before.

Top 3 Beginner Rooms

Two players were involved in the hand. Both players check at the turn. Player A checked at fourth street, but Player B bet enough to put Player A all-in. The dealer thought that Player A folded, and put the rest of the cards into the muck, and pushed the cards to the next dealer.

Player B started to take the pot down, but Player A said he was going to call the bet. Since neither player had mucked their hand yet, the table decided that they thought the next two cards (burn and river) were still at the top of the pile.

Although no one was 100% certain which cards should be dealt, they decided to burn and turn over the river card, which gave Player A the winning hand. The deck could not be shuffled since it was mixed in with the other player's mucked cards.

What should we have done?

Hi Calvin,

It sounds like you where playing in a home game, and rules can vary vastly from one game to another. I think you solved the situation in a good way though. Of course, it is better to have rules for every single situation that might occur, but that is difficult. My advice is to try to agree on a solution like you did, and if that is impossible, you should have a vote.
