Mucking The Winner

Question: Hi, I was playing in a home game with a couple guys and this one guy, micheal had an Ace with two aces on the board, and the other guy, collin, had pocket jacks with a jack on the board. When connor saw michael had the ace, he said, "I knew you had the ace", and he put up his cards. So Michael had 3 aces, and connor had a full house jacks full of aces but he never realized this till the michael took the chips and put them in his pile. Neither person realized this until the next cards had been dealt. Should michael give connor the money or should he keep it because connor made the mistake. I would really appreciate it ifyou could give me an answer about this because I think that since connor never realized the mistake, he should be punished and win all cards are up, the hand is finished.

Answer: These situations are usually settled by the floor person. He's the casino guy who gets called to referee problems. There are two ways to handle it and I'm not sure which would be used since I didn't see the exact chain of events. The prevailing rule is that if you muck/discard your hand, then it is dead. What that means is that if your cards go into the discard pile (even just touch them a little), then the hand is considered folded and out of the running.

There are no exceptions to this. Even if you know that your cards are right there, you can't do anything about it. On the other hand though, it is the dealers responsibility to make sure that the winning hand gets the pot. If the dealer saw that he had Jacks full, then he should get the pot even though he didn't think it was the winner.

This happens to everyone. Sometimes we miss that we have a straight or a flush and turn over our cards and then we get a pleasant surprise. But you can't do that if you just throw your hand away. So the ruling comes down to whether or not he showed his hand before mucking it. If he did show it then he gets the pot, if he didn't show it to the dealer then it goes to Michael.
