Declare Hand In Holdem?

Question: Three part question:

1. I am the dealer but am out of the hand. The player who is called card turns over his cards and says he has a pair. However, unknowingly he has a straight. The opposing the player has a higher pair and tries to take the pot (as the player with the smaller pair acquiesces). As the dealer, am I allowed to call the straight as the winning hand or is it between the two players to decide?

2. After shuffling the cards and the deck is cut, do you burn a card when dealing the two hole cards?

3. Is there any rule on who cuts the cards?

1. In Texas Holdem, in addition to dealing cards, the dealer is responsible for evaluating the showdown hands and awarding the pot to the winning hand's owner. The players do not need to declare their hand to win. Misreading your hand then doesn't matter. The dealer in your case should notice that the person has a straight and award the pot to him.

2. No, you don't burn a card before dealing the hole cards. You only burn before the flop, turn and river cards.

3. No, there is no rule for who cuts the cards. This is a question for home games. In a casino, at no time, are players are not allowed to touch any other cards than their own personal cards. For home games, I would recommend that any person who is dealing just takes the role of a dealer in the casino -- meaning they cut the cards themselves. Cutting cards in home games is most likely an attempt to prevent cheating. Number one, if you are against someone who is potentially a cheater, I recommend booting him/her from the game. Secondly, a skilled cheat wouldn't be stopped by cutting the cards.
