Answer: In most cases yes, you compare their second card (the "kicker"). The rule is that the best five cards win. So that means if you both have nothing and one person has a higher five cards then the other, he wins. For example, if you have Ace high and he has King high. Sometimes "the board plays" too, in which case everyone splits the pot.
Remember in texas holdem you can use your two cards plus the five community cards to make the best hand. If the best hand, five cards, is the community cards then you split. This happens sometimes if there is a straight on the board or a flush and no one has a suite bigger then that on the community cards. That's a general question so I may not have explained your specific example. If so then email me again and I'll answer it in more detail.
