Using Info From People Acting Out Of Turn

Question: I was in a game and I was first to bet after a flop. The person to the left of me checked the bet out of turn. The next person then bet. I watched to this point knowing they had played out of turn. At this point it was discovered that they bet out of turn. I watched them bet out of turn and used the info to decide my hand. I was told by someone at the table that I am forced to fold if I do this. Who is right? Aren't I allowed to take advantage of anothers common mistake?

Answer: That's a good question. To be honest I don't know. I think it depends on where you were playing. At some card rooms where I have played when someone acts out of turn and there is action behind him (someone else also plays after), then it can't be taken back. You would just get to act last in that case as if you had checked. I definitely haven't heard anyone's hand being folded for acting out of turn.

I've also heard the floor person be called over who settles the dispute to his liking, whether that be taking the out of turn bets back or doing what I mentioned above. If this is a home game then I would probably just say that you get to act last (like you checked) but give a warning. If it happens again then you'll get to act first and use the information.
